Terms of Service

1. General Provisions

1.1. These Terms of Service (the “Terms”) govern the relationship between VibeX LLC (the “Operator”) and any individual or entity (the “User”) accessing or using the BrandWise service (the “Service”), available at https://brandwise.tech.

1.2. This service is provided by VibeX LLC, a company registered in the United States.

1.3. BrandWise provides tools for measuring and analyzing brand representation in AI model (LLM) responses.

1.4. By using the Service, the User fully and unconditionally accepts these Terms. If the User does not agree with the Terms, they must stop using the Service.

1.5. The Operator reserves the right to modify these Terms at any time. The current version is available at https://brandwise.tech/terms. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Registration and Account

2.1. To use the Service, the User must register by providing a valid email address.

2.2. The User is responsible for the accuracy of the information provided and for maintaining the security of their account.

2.3. The User must immediately notify the Operator of any unauthorized use of their account.

2.4. The Operator reserves the right to suspend or terminate the User's account for violation of these Terms.

3. Use of the Service

3.1. The Service is provided on an “as is” basis. The Operator does not guarantee uninterrupted operation and may perform maintenance with temporary access restrictions.

3.2. The User agrees to:

  • Use the Service only for lawful purposes and in accordance with these Terms.
  • Not take actions aimed at disrupting the Service, including unauthorized access attempts, server overload, or introduction of malicious code.
  • Not use the Service to distribute illegal, offensive, or misleading content.
  • Not perform automated data collection (scraping) from the Service without written permission from the Operator.

3.3. The User is solely responsible for the content of projects, brand configurations, personas, and scenarios created within the Service.

4. Payments and Balance

4.1. Features of the Service related to running AI model evaluations are provided on a paid basis. The User pays by topping up their AI credit balance.

4.2. Payments are processed through Stripe. The payment processing integration is currently in development. The Operator does not store full payment card details.

4.3. Funds are deducted from the User's balance based on actual usage of the Service (running scenarios, AI model queries). Pricing is determined by the current rates displayed in the Service interface.

4.4. Refunds of unused funds are processed upon written request to contact@vibexsoft.com within 30 business days.

4.5. First Card Linking Bonus. Upon the first successful card linking, the User receives a one-time bonus of 1,000 AI credits (the “Bonus”). Bonus conditions:

  • The Bonus is credited only once — upon the first card linking. Relinking a new or the same card does not entitle the User to another Bonus.
  • Within a single organization (group of projects), the Bonus is granted to only one User — the first member to link a card. Subsequent members do not receive the Bonus.
  • AI credits granted as a Bonus are not monetary funds, are non-refundable, and cannot be transferred to other Users.
  • Bonus credits are used to pay for Service features on the same terms as purchased credits.
  • The Operator reserves the right to change the Bonus amount, suspend, or terminate the promotion at its sole discretion. Notice will be posted in the Service interface at least 3 calendar days before the changes take effect. Already credited Bonuses are preserved in full.

5. Intellectual Property

5.1. All exclusive rights to the Service, including its design, source code, databases, trademarks, and other elements, belong to the Operator.

5.2. The User retains rights to content created within the Service (brand configurations, scenarios, descriptions).

5.3. Evaluation results (reports, metrics, quotes) are generated automatically by the Service. The Operator does not claim exclusive rights to such results and is not responsible for their content.

6. Limitation of Liability

6.1. The Operator shall not be liable for any damages arising from the use or inability to use the Service.

6.2. The Operator does not guarantee the accuracy, completeness, or timeliness of evaluation results. Results are informational in nature and should not be used as the sole basis for legally significant decisions.

6.3. The Operator is not responsible for the actions or inactions of third-party services (payment systems) or for disruptions in their operation.

6.4. The Operator's total liability to the User is limited to the amount actually paid by the User for the last 3 months of Service usage.

7. Privacy

7.1. The processing of the User's personal data is governed by the Privacy Policy, which is an integral part of these Terms.

8. Dispute Resolution

8.1. All disputes arising from these Terms shall be resolved through negotiation. If the parties cannot reach an agreement, the dispute shall be submitted to the courts of the State of Florida, United States, in accordance with applicable US law.

8.2. Prior to filing a formal claim, the parties agree to attempt resolution through written correspondence. The response period is 15 business days from receipt of the claim.

9. Final Provisions

9.1. These Terms take effect from the moment the User begins using the Service and remain in effect indefinitely.

9.2. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
