1.1. This Privacy Policy (the “Policy”) describes how VibeX LLC (the “Operator”) collects, uses, and protects personal data of users (the “User”) of the BrandWise service (the “Service”), available at https://brandwise.tech.

1.3. By using the Service, the User agrees to this Policy. If the User does not agree, they must stop using the Service.

1.4. The Operator processes personal data in compliance with applicable United States federal and state privacy laws.

We collect and process personal data for the following purposes:

• Registration and identification — creating an account, authentication, session management. Data collected: email address, IP address, User-Agent, locale and timezone parameters. Retention: until the User deletes their account or 30 days after the last use of the Service.
• Service delivery — providing access to brand evaluation features in AI model responses, generating reports, managing projects. Data collected: project contents, brand configurations, personas, scenarios, evaluation results. Retention: for the duration of the account.
• Payment processing — balance top-ups, usage charges, bonus AI credit accrual upon first card linking (including eligibility verification and abuse prevention). Data collected: last 4 digits of payment card, card type, expiration date, transaction history, amounts, bonus receipt date and status. Retention: 5 years from the date of the transaction (in accordance with legal requirements).
• Communications — sending notifications about Service status, changes to terms, access codes. Data collected: email address. Retention: until the User unsubscribes or deletes their account.
• Service operation — cookies, technical logs, error diagnostics. Data collected: cookies, technical identifiers, IP address, User-Agent. Retention: up to 1 year.

3.1. The Service uses cookies for user authentication, storing preferences (language, timezone), and usage analytics.

3.2. The User may disable cookies in their browser settings. Disabling cookies may limit the functionality of the Service.

4.1. The Operator shares personal data with the following third parties solely for the purposes described in Section 2:

• Stripe — payment processing and card tokenization. Data shared: payment information, transaction identifiers. The payment integration is currently in development.

4.2. The Operator does not sell, trade, or otherwise transfer personal data to other third parties, except as required by applicable law.

You have the right to:

• Request information about what personal data is being processed.
• Request correction, restriction, or deletion of your personal data.
• Withdraw consent for data processing by sending a request to contact@vibexsoft.com.
• If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt out of the sale of personal information.

The Operator commits to:

• Process personal data solely for the purposes described in Section 2.
• Maintain the confidentiality of personal data and implement appropriate organizational and technical measures to protect it from unauthorized access.
• Respond to User inquiries within 10 business days of receipt.
• Cease processing and delete personal data within 30 days of receiving a withdrawal of consent.

7.1. The Operator implements appropriate organizational and technical measures to protect personal data from unauthorized access, destruction, alteration, blocking, copying, distribution, and other unlawful actions.

7.2. Data transmission is conducted over secure channels (TLS/HTTPS). Passwords and tokens are stored in hashed form.

8.1. This Policy applies exclusively to the BrandWise Service. The Operator is not responsible for actions of third parties who gain access to User data through no fault of the Operator.

8.2. The Operator reserves the right to modify this Policy. The current version is available at https://brandwise.tech/policy. Changes take effect upon publication.
